Protection of Industrial Property in the Republic of Lithuania
The system of industrial property in Lithuania functioned well until 1940 (Trademark Act of January 27, 1925, Inventions and Improvements Act of May 14, 1928 and Industrial Models and Designs Act). After Lithuania declared its independence on March 11, 1990 it started re-establishing independent national industrial property legislation.

The State Patent Bureau
The State Patent Bureau (SPB) was established on April 12, 1991. Its main duties include the protection of industrial property (inventions, industrial designs, trade and service marks, company names), drafting legal acts in the field of industrial property and representation of the Republic of Lithuania in international organizations and international events regarding industrial property protection. The staff of the SPB is currently 64 persons.

Legal Acts
The Decree on Company Names entered into force on October 31, 1991.
The Law on Competition entered into force on November 1, 1992.
The Trade and Service Mark Law entered into force on October 1, 1993.
The Patent Law entered into force on February 1, 1994.
The Industrial Design Law entered into force on September 1, 1995.

International Agreements
Lithuania (LT) is a member of:

  • Convention Establishing the World Intellectual Property Organization (WIPO) since April 30, 1992
  • Paris Convention for the Protection of Industrial Property since May 22, 1994
  • Patent Co-operation Treaty (PCT) since July 5, 1994
  • A Co-operation and Extension Agreement with the European Patent Organization (EPO) for the extension of European patents to Lithuania since March 1, 1994
  • Trademark Law Treaty (for uniform registration procedures) was signed on October 28, 1994, but has not yet been ratified. An agreement with the Government of the USA is under discussion. When ratified, it will enable US and foreign owners of US patents for pharmaceutical products to obtain pipeline protection for pharmaceutical products for which US patent applications were filed from February 1984 up to February 1994.
The Publications
The Official Gazette of the State Patent Bureau of the Republic of Lithuania Isradimai, pramoninis dizainas, prekiu ir paslaugu Zenklai, firmu vardai is issued monthly. Annual reports of the State Patent Bureau and patent specifications are issued on paper and, together with the patent documents of the Czech Republic, Slovakia, Poland, Hungary, Romania, Bulgaria and Latvia, on the common CD-ROM ESPACE-PRECES.

Representation
Foreign natural and legal persons, whose ordinary residence or principal place of business is outside Lithuania must be represented before the SPB by patent attorneys registered in the Register of Patent Attorneys of the Republic of Lithuania.

Their legal status is based on the Regulations of patent attorneys approved by the Government on May 20, 1992.

The list of 45 currently registered patent attorneys is available upon request from the SPB.
